102.0 ENFORCEMENT OF CONSTITUTION AND BY-= LAWS

The member school has the responsibility to educate students, coaches, directors and o= ther appropriate persons of the state association requirements delineated within= the Constitution, By-Laws and Board Policies, as adopted by the member schools, which could affect them. Furt= her, the member school shall monitor its compliance with all requirements contai= ned within the Constitution, By-Laws and Policies and enforce the same in regar= d to the school staff, students and other appropriate persons. The principal and/or superintenden= t of the school shall be responsible for the enforcement of the Constitution and By-Laws of this Association and shall be the official representatives of th= e school.

a. The administratio= n of the school shall be responsible for the eligibility of its students.

= &= nbsp; 1. The principal and athletic/activities director at each member school shall be required to att= end an annual rules meeting regarding MSHSAA by-laws, policies, and rationale f= or the rules.

= &= nbsp; 2. When representati= ve(s) of the school do not attend, the school shall give reason in writing to the executive director for the representative(s) being unable to attend.

= b. The minimum penal= ty for using an ineligible student during the regular season and in MSHSAA tournam= ent activity is as follows:

= &= nbsp; 1. Team Sports (baseball, basketball, field hockey, football, soccer, softball, volleyball, and water polo). The school must--<= o:p>

= &= nbsp; &nbs= p; (a) Forfeit all contests involved= .

= &= nbsp; &nbs= p; (b) Adjust its place in conference standings and/or relinquish its place in tournament standings.

= &= nbsp; &nbs= p; (c) Return team and individual aw= ards.

= &= nbsp; 2. Individual Sports (cross country, golf, gymnastics, swimm= ing, tennis, track & field and wrestling). The school must--

= &= nbsp; &nbs= p; (a) Forfeit all events in which student(s) were involved.

= &= nbsp; &nbs= p; (b) Reduce team points (score) and adjust its place in conference standings, and/or its place in tournament standings.

= &= nbsp; &nbs= p; (c) Return awards of individual(s= ) and, if appropriate, after adjusting standings, team awards.

= &= nbsp; 3. Tournaments (incl= uding MSHSAA tournaments) -- Team or student most recently defeated upon discover= y of violation replaces offending team or student for remainder of tournament series.

= &= nbsp; 4. The penalty of forfeiture may be waived in cases involving a student who transfers schools= and evidence is provided that the student, although ineligible, is permitted to participate as a result of false information being provided by his previous school upon which the student was certified to have been eligible. Likewise, the Board of Directors shall have discretionary authority to determine whet= her a penalty is appropriate and the nature and duration of such penalty in cas= es where a student is determined to be ineligible under the Transfer of Enrollment Standards because of school officials failing to follow established procedures for certifying his/her eligibility and the student is later determined to be eligible in all respe= cts except for the administrative oversights.

= c. If a student who = has been declared ineligible is permitted to participate in interscholastic competition because of a court restraining order and/or injunction against = the school or MSHSAA and if such restraining order and/or injunction subsequent= ly is voluntarily vacated, stayed, reversed or finally determined by the courts not to justify injunctive relief, one or more of the penalties outlined in = b. above may be taken in the interest of restitution and fairness to other mem= ber schools.
